Abstract EN

The main objective of this research is to highlight a form of diligent jurisprudential work which does not rely on partial texts referring to a specific provision of a certain case as much as it depends on the general rulings of Sharia and its objective rules.

Those rules eventually integrate with partial texts to produce a legal provision controlled by both partial texts and general rules.

In addition، this research illustrates the spirit of Islamic jurisprudence and its lofty objectives which tackle the intensity of certain constant measurements and pure fundamentals.

Such treatment was brought about by the Islamic Sharia as stated in the verses of the Qur'an and the Hadiths of the Prophet (peace be upon him).

Accordingly، this research consists of an introduction، three chapters and a conclusion.

The first chapter handles the concept of jurisprudential irregularities.

The second chapter focuses on the fundamental adaptation to jurisprudential irregularities.

The third chapter displays the relationship between the concept of jurisprudential irregularities and the fundamentalist studies.

The conclusion sums up the findings of the research.

For example، jurisprudential principles are originally consistent and constant but occasionally، there are exceptions based upon clues and evidence that make them preponderant.

A second finding of the research states that jurists utilize jurisprudential irregularities to highlight indicative meanings and objective provisions.

A third finding refers to the people of the Sunnah who take to jurisprudential irregularities، in some cases، because Almighty Allah is all-perfect.

In addition، fundamentalists take to jurisprudential irregularities to keep the legal rules consistent.

The Islamic Sharia is keen on displaying what is contrary to the fundamentals more than what is compliant with them.

A fourth finding shows that it is not permissible to resort to jurisprudential irregularities in case of probability، but it is obligatory to have a truthful evidence.

Finally، the research stresses the importance of linking major to minor issues، and vice-versa when referring to the canons of true religion.
