Abstract EN

The purpose of this research is to conduct an analytical study of the legislative role of (judgment as if in presence) as those expressed by the Jordanian legislator through the new amendments he made to the law amending the Criminal Procedure Law No.

32 of 2017 which came into effect on March 1, To determine the implications of the presence or absence of the complainant for the stages of preliminary investigation and trial, on ways to appeal this type of penal provision.

This research dealt with in the first requirement the classification of criminal sentences according to the rule of the Jordanian Penal procedures Code by discussing the scope of its application to this rule and determining its impact on the classification of penal provisions.

While in the second requirement, the research dealt with the rules for challenging the judgments in the Jordanian legislation in terms of the conditions of accepting the appeal against the rulings issued as the facets and the privacy aspects in them.

Finally, the conclusion of the research included its findings and recommendations.
