إن ضروريات الدخول في اقتصاد السوق، و تدعيم فكرة الاستثمار دفع بالمشرع إلى إدراج جملة من التعديلات بموجب الأمر رقم 08 / 04 المحدد لشروط و كيفيات منح الامتياز على الأراضي التابعة للأملاك الخاصة للدولة الموجهة لإنجاز مشاريع استثمارية، و هو نظام يتضمن امتياز غير قابل للتنازل، و يمكن هذا النظام المتعامل الاقتصادي من استغلال الوعاء العقاري التابع للأشخاص العمومية دون أن يكون مضطرا لتوظيف جميع رؤوس أمواله فيه.
و تهدف هذه المقالة إلى إزالة الغموض عن الشروط التنظيمية و التعاقدية لعقد الامتياز في ضوء الأمر رقم 08 / 04، و تم التوصل إلى أنه بموجب هذا الأمر تم وضع تدابير جديدة تهدف لتنظيم العقار الموجه للاستثمار، حيث أن منح الامتياز بالتراضي أحسن وسيلة للتحكم في العقار الصناعي و توقيف المضاربة به، كما تعد صيغة للوقوف بوجه السماسرة.

The necessities of the market economy and the investment prompted the legislator to include a number of amendments under ordinance No.
08 / 04, a system of non-transferable concession, which enables the economic operator from exploiting the real estate base of public persons, without investing all his capital in it.
this article aims to demystify the regulatory and contractual terms of the concession contract in light of ordinance No.
04 / 08 ; hence, new measures have been put in place to regulate investment-oriented real estate, and stop speculation in it, as it is a formula to stand up to the brokers.
