تهدف هذه الدراسة إلى إلقاء الضوء على أهم اختصاصات المحكمة الدستورية في مجال الرقابة على دستورية المعاهدات الدولية، هذه الرقابة التي عرفت تطورا هاما في ظل التعديل الدستوري 2020، فرضه الطابع القضائي الذي أصبحت تتصف به المحكمة الدستورية، والذي يتمثل في توسيع عملها على مستوى اختصاصاتها الدستورية والتشكيلة النوعية لها، ما يمكنها أن تساهم في ضمان مبدأ سمو الدستور واحترام مبدأ تدرج القواعد القانونية وتحقيق التوافق الدستوري، وخاصة ضمان مكانة المعاهدات الدولية في الهرم القانوني الداخلي، هذا التوسيع في اختصاصاتها الذي جاء به دستور 2020 ما من شأنه أن يساهم في تفعيل دور المحكمة الدستورية وتفادي القصور الذي انتاب المجلس الدستوري سابقا في مجال الرقابة على دستورية المعاهدات الدولية بالخصوص.
Abstract EN
This study aims to shed light on the most important competences of the constitutional court in the field of oversight of the constitutionality of international treaties.
and its qualitative formation, which can contribute to ensuring the principle of supremacy of the constitution and respect for the principle of gradation of legal rules and achieving constitutional consensus, especially ensuring the place of international treaties in the internal legal hierarchy.
and to avoid the shortcomings that the constitutional council had previously experienced in the field of monitoring the constitutionality of international treaties in particular.
