الوقف هو حبس عين المال المملوك عن التصرف و تخصيص منافعه للبر و لو مالا.
و قد تم تنظيمه في القانون الأردني من خلال عدة قوانين، و لكن القانون الرئيس الذي ينظمه و يحكمه هو القانون المدني الأردني رقم 43 لسنة 1976، و الذي استمدت معظم قواعده و مبادئه من الشريعة الإسلامية الغراء.
هذا البحث يناقش الأحكام القانونية العامة للوقف في القانون الأردني و تطبيقاته و دوره في خدمة المجتمع، و قد خلص إلى أن الوقف-كنظام قانوني-يمكن في الوقت الحاضر أن يؤدي دورا متميزا في تحقيق التنمية الاجتماعية و الاقتصادية في المجتمع الأردني.
Abstract EN
waif is the locking-up of the title of an owned property from disposition and the allotment of its benefits to charity, even though as of a future date.
Infer the Jordanian law waif is regulated by many Acts, but the main Act that regulates and governs waif is the Jordanian Civil Code No.43 of 1976 which is by and large derived from Islamic law (Shari'a).
This article has discussed the general legal rules of waif in the Jordanian law and its applications and role in serving the society.
It has reached the conclusion that waif, as a legal institution, can nowadays play a distinguished role in achieving social and economic development in the Jordanian.
