Abstract AR
لفلسفة العقوبة في الإسلام منحى قيمي و أخلاقي و تربوي، فهي عقوبة ردعية و ليس قمعية، و بذا تميزت عن وسائل العقاب المعاصرة لها فلم تكن غاية و وسيلة بل هدف لتحقيق غاية و وسيلة هي الإصلاح للفرد و المجتمع.
جاء ذلك من خلال التشريع و الفقه الإسلامي التشريعي الذي اختص به الشارع الأعظم سبحانه و تعالى.
و الفقه الذي هو احد مصادر التشريع في الإسلام الذي أكده الفقهاء و العلماء.
و ما طبق من السنة و عمل بها في عهد الرسول محمد (صلى الله عليه و آله و سلم) و صحابته (رضي الله عنهم).
و كذلك جاء الإسلام بقواعد تشريعية مشابهة لما هو موجود اليوم في أرقى القوانين و أفضلها و التي منها لا جريمة و عقوبة إلا بنص و إعفاوه من العقوبة خير من العقوبة المخطئة.
أما السجن فلم يكن موجود في صيغتها المعروفة حتى عهد الإمام علي (رضي الله عنه)، الذي أولى اهتماما خاصا بالعدل و العدالة و كذلك بالقضاء و القضاة و اهتمامه بالإحكام التي يصدرونها فكان يتابعها بدقة و ينصف المظلومين.
Abstract EN
The philosophy of punishment in Islam-oriented values and moral, educational and deterrent punishment is not marked by repressive means of punishment for her contemporary was not very objective but a means to an end and a means of reform is the individual and society.
This came through law and Islamic jurisprudence legislative singled out by the street, the great Almighty and jurisprudence, which is one of the sources of legislation in Islam, which was confirmed by scholars and scientists.
