Abstract EN

This study discusses the conflict between theshar'ievidence“legalevidences” and the approaches of the scholars in raising it.

The legal evidences related to the Jihad Al-Tlab has been taken as an example to clarify the approaches that Islamic scholars have followed in raising/removing the discrepancy.

It is well known to all scholars that the conflict between the shar'i evidence isonly apparent conflict in the mind of an Islamic jurist, and in order to remove that conflict heneeded to follow one of the approachesthat clarified by the fundamentalistsscholars, such as using the consensus, preponderance or abrogation of evidence, until he found that all clear and right legitimacy texts are consistent with each other and there is no any contradiction between them, because it is all from one legislator, who is Allah, he is indeed full of knowledge and wisdom
