Abstract EN

This study deals with the legal scope of the application of the theory of counter-administrative decision.

the basis of this theory is the issuance of a new administrative decision to cancel or amend a proper individual administrative decision, which ends with that decision and its future effects only, without the consequences of the past in this study, and in general, we find that the application of counter-decision theory is confined to individual legitimate administrative decisions, which enjoy final status.

after reading and in-depth research, we have concluded that administrative decisions are finally out of the scope of the counter- the most important of which are: the nullified decision, the organizational decision and the decision issued on the basis of deceit and fraud and the revealing decision of the right.

we have detailed the concept of these decisions and the obligations of their illegality, which leads to the impossibility of being subject to the application of the theory of counter-administrative decision.

scientific and precision represented by administrative decision falsehood and the applicability of the theory of administrative decision-counter in the face.
